A History of the Injustice & PROOF of the TRUTH
1) In 1990 the Garfield County BOCC cited Bill Vezzoso for running his excavation business from his property;
they took him to court [Case # 1990 M 0000263] along with 4 or 5 other excavators in 1991. The 1990-1991 BOCC resolved and decided to instruct the sheriff to go to 4 or 5 excavators properties and issue summons for the storage of heavy equipment. The county prosecutor and a county representative came together and offered some excavators the right to use up to 10 pieces of equipment if they had 5 or more acres. Anyone with less than 5 acres, like Frogg Excavation, was put out of business by the decision and Joe Zamora and William Vezzoso were allowed up to 10 pieces of heavy equipment. Zamora's deal included stipulations to conceal his equipment because of Hwy 82. The county did stipulate conditions for William Vezzoso because there was such little development and traffic near the 100 road that it wasn't a concern then.
- updated 5/16/08
2) The county is now trying to say that never happened and shut Bill Vezzoso's business down based on a
false "anonymous complaint". They are doing this in light of 5 people testifying that the county made
the agreement in 1991 to let them continue.
a) Frogg Excavation, Jerry DesJarlais
Who was put out of business because he didn't have enough property to support it, he had less than 5
acres. The county shut down his business as a result of the 1990-1991 BOCC action that concluded with him "not prevailing."
b) Joe Zamora
Who was grouped with Bill Vezzoso and allowed to keep up to 10 pieces of equipment on his property
along with others in his group as long as they had a large enough sized property (5 acres or more).
c) Bill Vezzoso
He has testified to what happened. It may be hard for others to remember the details, but since the
county was trying to stop his way of supporting his family, he remembers every detail.
d) Bruce Hammer
He testified in front of the county that he sat side-by-side with Bill Vezzoso in the court house in 1991.
He remembers the agreement exactly and has offered his sworn statement and has even offered it
under a polygraph test.
e) Eagle District Judge, Fred Gannett
Gannett represented Joe Zamora and was the attorney on record for Bill Vezzoso and testified to The County that there were two groups,
those that prevailed absolutely and those who didn't. Gannett stated, "It may simply modify what other enforcement actions could be taken by the county against that defendant for the same type of violation." BOA Transcript P90 L7-L14. "Mr. Vezzoso, my memory tells me, fell into the category of Mr. Zamora and there then offered a similar deal by the county prosecutor." BOA Transcript P79 L20-25 P80 L1-2.
3) The county forced Bill Vezzoso into a public meeting on Feb 5th, 2007 where the Vezzoso's provided a 19 page response as to why they have every right to do what they are doing on their property. The commissioners couldn't respond after their presentation and made a motion to adjourn for a month so they could "review" the information.
4) The county returned on March 12th, 2007 and told him he had to stop his
25-year old business, and ignored many things, including testimony from 5 people. The county ignored
people that they forced out of business and is now saying it didn't happen and if it did it wasn't official.
They have a letter from Frogg Excavating who they put out of business, but continue ignore it along with testimony from an Eagle
District Court Judge.
5) Bill Vezzoso is fighting to get his rights back, but needs your support to send a message to the Garfield County that they shouldn't be allowed to ignore testimony from 5 people to shut down a 25
year old business. The county is wasting our valuable tax dollars to shut down Bill Vezzoso's livelihood
who has lived in the Roaring Fork Valley for over 40 years.

The commissioners have never responded to the response provided by the Vezzoso's and power point presentation(27mb)at the Feb. 5, 2007 BOCC Meeting (read the transcript here). At the end of the Feb 5th, 2007 meeting, Larry McCown motioned to adjourn because, "we [the BOCC] were given an overwhelming amount of information that was not in his packet to read prior to this meeting not to mention all the testimony that's been given here today." (Feb 5 BOCC Transcripts - P18) But in the next March 12th meeting they failed to answer any of the questions and arguments posed by the Vezzoso's on Feb 5th BOCC meeting, which McCown himself called the materials "overwhelming."
This attack was carried out by Ron VanMeter who, in a letter to the Vezzoso's, tried to cite them with any and every different kind of violation hoping something would stick. All the of the county's accusations have been responded to, but they continue to pursue and attack the Vezzoso's - all based off an "anonymous" complaint about some dirt in a pasture that complains about "Impact on property values is estimated to be 25% to 30% because of this mess." Could it be that a neighbor, who also happens to sell real estate, is more interested in trying to increase his Willow Lane property and convinced a few select neighbors? The real question is how can this kind of letter prompt any action at all let alone the History of Harassment from Garfield County on the Vezzosos'. - updated 5/17/08
stopGARCOinjustice.com would like to ask Trési Houpt and Larry McCown why they refuse to answer the point by point response to the county's claims against the Vezzoso's.
Not one of the county's "CODE COMPLIANCE" issues with the Vezzoso's were in the complaint, yet their position is they had to respond because they have to respond to every complaint. And to each and every issue of the 5 they still contend, the county has ignored 5 witnesses, court documents, and failed to respond or provide a counter argument when pointed to the specific laws (section by section) of why the Vezzoso's have every right to do what they are doing on their property. Every time the Vezzoso's respond the county either ignores it or searches for loopholes by trying to use definitions from other laws, conveniently ignoring the actual definition in that section. It's time the county answer why they can't read the law in black and white.
After the BOCC ruled in March 07' the Vezzoso's filed an appeal with the Board of Adjustments as the next step to resolve the injustice caused be Trési Houpt and Larry McCown. The BOA, to no ones surprise, on May 30, 2007 agreed with their fellow county board members and also ignored, in an official hearing, 5 witnesses, court documents, testimony from a now District County Court Judge Gannett who was the lawyer on record for Bill Vezzoso in 1991 and testified to this matter at the BOA Hearing. Read the Judge's testimony here. Read the transcripts here (27mb). How does this kind of behavior go on in this day and age? How can these people tell citizens of Garfield County what they can and can't do, no matter what the law says or what agreements it has made in the past?
Now the Vezzoso's only recourse is to sue the county under Rule 106, which is not what they want to do, it is still possible for Trési Houpt and Larry McCown to join John Martin in correcting this injustice. We hope if enough citizens and people from all over Colorado voice their opinions it will make them realize they need to fix this and fix this now.

A few recent petition signer's and comments:
"This is a true picture of how wasteful our Government is, and it is a shame that some one like Billy and Kim have to go to an extent like this to work in this valley. I believe that the time would be well spent on the rappers of our land ie: ENCANA-BARRET-WILLIAMS-KEY ENERGY- the list goes on. Shame on you Trési' for standing with McCOWN who is well known for stabbing locals in the back, we will be glad to see him go and thank our lucky stars he is gone! I knew Buck Arbaney as an upstanding man and this is a shadow on his good work. Garfield County is becoming a bad place to live and it is our Commissioners who have made it this way. If I do not hear that changes have been made on this matter I will personally make it my work for the months that it takes to get each of these commissioners gone. Change is now or watch out. WE locals are over being pushed. Get out of the way cause here we come. McCown your the worst." - Lori Anderson-Thompson, Silt
"I clearly remember the 1991 decision to allow 10 pieces of equipment on 5 acres or more in Garfield County. Because I was looking for property at the time and I own equipment. So I purchased property in 1994 believing that it met the conditions of Garfield County. I don't understand how GC can make a ruling in 1991 and then act as though it never happened. And not give the Vezzoso's a reasonable court date, it looks like they are trying to run them out of money. Garfield County needs to be held accountable." - David Wanzer, Silt
"For over two decades the Vezzoso farm/business operation has been conducted legally. Why all the doubt and suspicion? Why hasn't this matter been resolved months ago ? The fact this dispute has involved so many for so long is clearly the result of county politics gone out of control. The Vezzoso's have long ago submitted supporting evidence for their case only to be met with official silence and/harassment. Now they have no other recourse but to bring suit which will cause an unnecessary expense to them and all of Garfield County taxpayers as well. Somehow, this process seems to prove that not all public stupidity is in Washington after all!" - John Buchanan, Carbondale
"I don't understand how a district judge that testifies on the behalf of the Vezzoso's is not believed. Garfield county officials are an embarrassment to all decent government workers. I hope they find out who is really behind this injustice and who pockets are being paid. When they do Garfield county should owe big time. Any time the Vezzoso's need a character witness I will be there." - Mitch W Miller, Carbondale
"I was there sitting side by side with Bill Vezzoso in the court house in 1991. I can't believe the commissioners are trying to act like they didn't tell Bill he could run his business and keep up to 10 pieces of equipment. I remember perfectly even if they don't. I extend my offer to take a lie detector test to prove it if they want, but they seem to ignore fact after fact." - Bruce Hammer, Glenwood Springs
"It seems to me, with the information that I have, the county resources and your valuable time could be better spent. Why can't everyone just get in a room and resolve this like "men." Isn't that the tradition of Garfield County..." - Peer Erickson, Carbondale
"I personally verified, out of curiosity and found that all the things in the newspaper article were true. SHAME on the Garfield county officials committing this atrocity. R.N.S." - Randell N. Smith, Glenwood Springs
"This is a witch hunt and should stop now! This all boils down to one disgruntled neighbor that somehow has convinced the county to waste our taxpayers dollars to try to put the Vezzoso's out of business. They should have looked next door when they moved in. The Vezzoso's have always had trucks on their property and have always had livestock (cows and pigs and horses) on their property on and off since they moved out there originally. This is an agricultural zone. The Vezzoso's take good care of their property and have been good citizens of the community and the county for many many years! STOP spending our tax dollars on these unsupported accusations and use our money for legitimate and needed things in our county. All the county is doing right now is trying to outspend and attempting to outlast the Vezzoso's at the taxpayers expense. John Martin is the only County Commissioner with common sense enough to know this is a non-issue and to not take action against the Vezzoso's. I too remember when the issue took place and the Vezzoso's were granted the right to keep up to 10 pieces of heavy equipment on the property. The issue is that the county didn't keep the records of the agreement. How convenient for them!" - Russell Brown, Glenwood Springs
"It's a shame that the county commissioners of Garfield County have nothing better to do or discuss than a hard working business owner's land and use of his property. You would think that the County of Garfield would be happy that they have residents in their county that are working for a living and providing jobs for other residents. You have people who care about this valley and the beauty of their county, it just amazes me that this is what has come of POWER AND POLITICS of the county commissioners that they would attack a family trying to make a living. Instead you would think there is far much more other important issues that should be addressed by the commissioners for the county." - Lisa Miller, Basalt
"I feel that it is extremely important to stand up for the small business people in our community and to be allowed personal freedom on private property." - Ann Honchell, Glenwood Springs
"This needs to be made right" - Margaret & John Wierenga, Parachute
"This case is a complete demonstration on an injustice on one hard working man and his business being torn apart by a corrupt system. This hard working blue collar American is being attacked from unknown reasons? Not only is he suffering but his family, employees and friends all feel the stress that now surrounds this honest mans life, I ask the county to step back and realize that the damage that they are doing is ruining an innocent mans life, how can this be allowed!" - Bryan Giem, Canon City

"You are elected officials charged with serving the public's interest- this issue serves no one and is a waste of time and tax payer's money. Bill Vezzoso is as hard working as they come and does not deserve this. Shame on you. Your names will be remembered in the next election- ones to NOT VOTE FOR." - Windsor Easley, Carbondale
"This is is proof positive that it's not what is right or wrong, but who has the most money has the most influence. Someone has to have those papers somewhere. Everything the government does goes on record. Someone knows where they are." - Sandra Lee, New Castle
"Since when is it right to go back on a court decision and now harass the Vezzoso's, let them be and go find something else constructive to do rather than picking on them, what's the hidden agenda to your harassing? " - Tammie Lee Spinden, New Castle
"This is hard to believe that Garfield County can do what ever it wants without consequences and ignoring laws. I also live in Mexico where this kind of behavior is expected, but I sure didn't expect it to come from our commissioners. Shame on you! Leave this family alone or make a valid argument like the Vezzoso's clearly have." - Bridget Giem, El Jebel
"I read the transcripts on the Feb. 5 meetings.lol How petty are these county commissioners? OMG.. They actually asked why the Vezzoso's had a Porta Potty on thier land. Is that a real issue? I don't think so. Here's two scary thoughts. One: Bill running to the bathroom in the house from the north pigpen. Two: This one is even more scary... These petty commissioners running for office again. Pssst. Hey commissioners. Have you ever heard the saying (all adults are responsible for his/her choices)? The facts and the testimonies are out there. You chose. Hopefully, it will be for the right side. The Vezzoso side." - Tim Barton, El Jebel
"This situation of "He said, they said" has been going on far too long. A decision was made in 1991 and I believe the county and its elected officials should stand by that decision. This is like changing the rules of the game if you don't like the rules. Where the Vezzoso's live is an agricultural area and they take excellent care of their home and acreage. Plus, and a big plus, is the contribution through the years that the Vezzoso's have made to Carbondale, its community and citizens. PLEASE reconsider and look at the facts and the testimony." - Janet Johnson, Carbondale
"I’ve known the Vezzoso's for over 35 years and cannot believe the injustice that appears to be happening to them in a community they have supported and helped for most of their lifetimes. The petty issues that are being discussed and the lack of resolution of the main issues does not reflect well on this county government. Allowing such issues to continue without resolution can only spark resentment within neighborhoods and cause new problems. Government personnel are elected or hired to support and resolve the issues presented to them, not to become part of the problem. These officials need to hold themselves to a higher standard to resolve these issues quickly and equitably by looking at the facts and data presented. Anonymous complaints and neighbor squabbles are inevitable in all our lives but should not become the source to take a family’s livelihood away that has been approved and/or determined acceptable by previous officials. From knowing the Vezzoso family all these years, I cannot believe any intent by them to disregard the law and to blatantly cause the problems being indicated. Bottom line, the county’s prior approval should be honored and the Vezzosos should be allowed to correct any remaining issues that are determined to not meet current laws or regulations, if appropriate. Then let the community move on with their lives without further destruction. " - Dixie Artamenko, Peyton

"I support the issues presented by Mr. & Mrs. Vezzoso & feel the county is being unfair in the resolution of this situation." - Larry Sorgen, Rush
"I live in California & heard about this issue from a friend. After reading what all has happened, I cannot believe that a local county government is allowing this type of injustice. I'm originally from Colorado & always felt the local governments were well above this type of railroading. How sad!" - Delle Andersen, Chula Vista, CA
"The position taken by the BOCC and supported by the BOA clearly needs to be reexamined. I lived in Carbondale from 1987-2002 before moving to Denver and I have known the Vezzoso family for many of those years and to the present day. While it would be easy for me to support them for this reason alone, I am urging that this matter be reconsidered based on the facts. To ignore existing testimony and court documents should not be acceptable under any set of circumstances and it pleases me to see that the Vezzoso family and community members both local and abroad are not going to simply allow this to happen. If these Garfield County officials continue their current course of action, the results will likely be of little significance to them. For a local business and more importantly, to a family, the results will be disastrous." - Brian Lee, Lakewood
"I have known the Vezzoso's for many years and cannot believe this is happening to them. I also can't believe the time, money, and grief that this is causing everyone. As they have been a member of your community for many, many years, and a business owner for most of those years, cannot understand why this has now become an issue. Need to get this resolved and let everyone get back to business!" - Jennifer Greiner, Fountain
"This is no way to treat a citizen of the United States. Especially one that owns land ,creates jobs for others, and helps his fellow man. This is a travisty." - Gary L. Oliver, Glenwood Springs
"Is there a bigger picture in the works that we are missing out on? What are the future plans of the valley from old downtown Carbondale to the Catherine Store. Who in that area and or in Garfield County will be pressured next? Will it be you? After the oil shale broke I moved to west coast for a couple of years and in that short period of time Garfield County took away my Agricultural Right on an 80 acre property so I know that it does happen. I have a feeling that some of the people that have been here the longest are going to be feeling it the most as I have seen with Pitkin County. How can Garfield County ignore what has been established in a court of law? Are we loosing our rights here?" - Joe Zelenka, Carbondale

"I know the Vezzoso's personally and they are wonderful people. I believe that our government is continuously taking away our rights, and we let them get away with it. If everyone would become united again, this would not happen. How can we let them take away a 25 year old business, but even more important a familys income ??? Have a heart, it is his property!" -Sheri Green, Grand Junction
"As a member of a family who ownes their own business, I understand how hard it is to make money in today's market without having to worry about someone shutting you down for such a small reason." - Jeffrey Clark, Golden
"I too once lived in Carbondale and can not believe that the county commissioners are treating someone who has lived in Carbondale for over 4 years and has a business that pays taxes, and hires persons from the local community to keep them off of welfare, or other hand outs in this matter. Does Colorado not have a "grandfather" clause. I live in city limits, but because my property was previously farm land, I can keep a horse, chickens, etc. I guess some rich snob that has nothing better to do has decided to line Garfield County Comm pockets. Shame on you for wasting precious tax payer money when we are in the midst of a recession. I am ashamed that myself and my family ever lived in that community that treats its citizens the way the commissioners are allowed to." - Debbie Aud, Oklahoma City
"It is sad to see this type railroading still going on in 2008. It does not matter if the decision was made in the halls or in the court itself. It was made and was binding for many years. It is appauling the county has chosen not to stand behind a previous decison right or wrong. What's next will we begin reversing overturned parking tickets, or deciding defendents originally found innocent are now guilty? This a gross waste of time and money. It is situations like this that fuel widespread distrust of politicians. This is not about equipment this is about pride and failure to be able to accept and admit when your wrong but instead Garfield County has choosen to do whatever they want because they think they can. Leave the Vezzoso's alone." - Johnathan Smith, Oklahoma City
"I would like to suggest to the County Commissioner's office to be fair and reasonable concerning this case. Closing down a man's business of 25 years and the only means of income for his family is unjustifiable. Instead of the government earning money through taxes from Vezzosos's business, it is sending this family into welfare, supported by our citizens taxes. The gov't is wasting our tax money this way. I hope and pray that your board will reconsider and do what is honest and righteous as good citizens of this country. " - Juanita Yap Millsap, Oklahoma City

"There is a discrepancy here; it looks like there is bias from the one that wrote letter. The bias may be such as a grudge from the one who wrote it, or maybe his life isn’t as good as he would hope it to be at this point in his life, a mid life crisis, and just angry at the world; any of those are not a reason to try and take it out on others. It’s a shame and its dishearting to see that a neighbor would take such action against another. With that being said it is my belief that there is an alternative motive behind this act and an alternative purpose. That is why the writer has gotten emotional and made it their personal vendetta to get their project done. I wonder if Trési Houpt or Larry McCown or John Martin have some kind of financial gain out of this heresy. Are they affiliated with anyone or any kind of work that is doubled by the Vezzoso’s? Do they look forward to get a friend some contracts that the Vezzoso’s now have? Or is it purely a who knows who kind of situation, who got in bed and promised something to the other?
